Contract awarded for Delivery of medicinal products 1. The subject of the contract is the supply of medicinal products, medical devices, foods for special nutritional uses and medical devices. 2. Medicinal products offered by contractors in these proceedings must meet the requirements arising from the Act of 6 September 2001 Pharmaceutical Law (consolidated text, Journal of Laws of 2024, item 686). (regarding groups 1-101 with the exception of groups 2 items 5 and 10, groups 10 item 1, groups 29 item 2, groups 64, 76, 78, 93 items 3 and 4,). 3. The contractor, offering a medicinal product, located on the list of drugs reimbursed when calculating the price, must take into account the provisions of art. 9 of the Act of 12.05.2011 on the reimbursement of medicines, foods of special nutritional purpose and medical devices (consolidated text, Journal of Laws of 2024, item 930) 4. Medical devices offered by contractors in these proceedings must meet the requirements arising from the Act of 7 April 2022 on medical devices (Journal (EU) 2017/745 of April 5, 2017 on medical devices, amendments to Directive 2001/83/EC, Regulation (EC) No 178/2002 and Regulation (EC) No 1223/2009 and repeal of the Council directives 90/385/EEC and 93/42/EEC (MDR) or Directive Council 93/42/EEC using the transitional period, established on the basis of Regulation (EU) 2023/607 of the European Parliament and of the Council of 15 March 2023 on amendment to ordinances (EU) 2017/745 and (EU) 2017/746 in relation to transitional provisions regarding certain medical devices and medical devices for in vitro diagnostics (regarding group 29 item 2, groups 93, items 3 and 4). 5. Foods of special nutritional purpose offered by the Contractor must meet the requirements arising from the Act of 25 August 2006. on food safety and nutrition (i.e. Journal of Laws of 2023, item 1448, as amended) and the Regulation of the Minister of Health of September 16, 2010. on the foodstuffs of special nutritional uses (Journal of Laws 2015 item 1026). (regarding groups 2 items 5 and 10, groups 10 item 1, groups 64, 78). 6. The Employer reserves the right to order less than the above -mentioned quantities of the abovementioned Products in the event of its demand, except that the contracting authority purchases a minimum of 40 % of the amount of medicinal products. 5. The minimum shelf life for the use of the offered medicinal product, a medical device, should be at least 12 months from the date of delivery.
